I am completely against capitol punishment! I don’t think we, the humans, have any right to finish anything that we didn’t start.
But after reading the news about this 12-year old girl being raped, I will not mind bending my principle! These guys should be tortured to death; a quicky is not for them.
All my condolences go out to that girl. I hope she can resurrect herself back from this pathetic unfortunate torture. I apologize to her on behalf of the society.
I hope that the Supreme Court doesn’t surprise me by showing leniency to the main culprit; just because he has confessed his crime. Supposedly there are other two accomplices whose information is available with the police department.
Aaaah.. I am just too scared if the dead-slow judicial system (its for right reason,) of ours is going to meet out the justice to her!

Where the hell are we going?
I definitely agree with you on everything. Being a law student I have gone through the dilemma of whether I should support Capital Punishment or not. And studying various cases helped me come to a conclusion that Yes in matters of rape cases and many such issues the accused when proved guilty should be torturd to death. There should be a retributive approach of punishment(eye for eye theory) followed.
Moreover, in matters of capital punishment, to tell you we do have cases where the most soft hearted President (APJ Abdu Kalam ) has also upheld the capital punishment of Dhanajay Chatterjee, when there were literally two groups one supporting the accused and pleading for his freedom whereas the other wanting him to be hanged. Almost every Human Rights activist was agitating against the decision of Supreme Court and the media was aiding them by showing his nearly- dying old father lying helpless outside their house and his old mother crying for her son and the media was getting good TRP.
No doubt the judicial system is quiet slow and definitely needs speedy trials and outcome of decisions, but the internal process makes it slow(this is no kind of justification.Even I get paronoid many times. But things are changing, though at a slow speed, they are. There are fast track courts for such matters. Various states have approved to follow these courts for matters relating to rape and other such serious offences.
Also you noted the number of rape cases registered where the victim knew the accused, here there have been guidelines given by various High Courts as well as Supreme Courts on keeping a check on how a female should avoid on exposing herself to any such unfortunate situation and that family members close to her should all the time take due care. But these are guideline and not legally enforced rules so they can be overlooked sometimes. Further it is needless to dicuss the given scenario of our country and the kind of lifestyle rural or urban girl faces. Still I am happy that there are institutions who are voicing this issue and the courts and other authorities are trying to find a way out. Also awareness programs are conducted through various legal aid camps to help women come out and speak about their (such)plights. But at times it becomes difficult for such voluntary camps to cater to the need of such huge population.
The system is changing and I am positive about it. Hoping that you also share the same view.
Further I would like to share one more view.
It is the cardinal rule of Capital Punishment that it is granted in the Rarest of the Rare cases. Hence in cases such as the above discussed it was rather obvious that capital punishment was to be declared. Considering the act even below the basic human tendencies. But the real crucial issue lies when the Judges have to keep their thoughts and emotions away and decide impartially on sentenccing of capital punishment in cases where the offence , by procedural law has the highest punishment for it as capital punishment but it lies on the Judges to decide the sentencing of it considering its severity and circumstances. Eg: matters pertaining to threatening the security of a nation. In such matters the Judges have a critical role to play while they decide on the sentence of the accused.
In addtion, BJP has been pushing the idea to sentence capital punishments to whoever proven guilty of rape charges. But there are again political and socital pressures and issues to be catered to.
Okay.. you have read only one news abt this. Everyday tehre are couple of news like this lying in inside pages of newspaper. Not even the kids of 4-5 years are spared...
Ketki was talking about takking due care for girls to not expose to these unfortunate incidents. How come girls of age 5-15 will be knowing this inhuman behaviour of some humans. But, its the society specially the males which sould be thinking 1000 times about the punishment before they get involved in these kinda acts.
